How to Get Court Records
Each route fills a different need. Indiana MyCase offers free public case data plus linked documents, so start there. When a case is public but a document image is missing, call the Clerk. The official file, certifications, judgments, older cases, and anything not linked online all sit with the unified Clerk of the Circuit & Superior Courts.
- Run a Kosciusko County case search and save the exact case number, assigned court, document title, and filing date.
- Download a public MyCase document when the record itself provides a permitted link.
- Visit the Clerk at the Justice Building, 121 N Lake St in Warsaw, for public inspection or a copy.
- Submit the county's online Clerk public-records form for a written request described with reasonable particularity.
- For mail service, print the copy form, name the record, select certification if needed, add a money order and self-addressed stamped envelope, and mail it to the Clerk.
- Call the assigned court for a hearing-specific question, or the Clerk for a copy issue. Official sources list 574-372-2331 and 574-372-2334 for the Clerk, so verify the current line.
The Clerk offers no general email, fax, or drop-box channel for record requests. Also, the county's general contact form is not a case filing route.
Kosciusko County Request Form
The online form is headed "Public Records Request FOR CLERK of COURTS." Full Name is the only field flagged as required in its validation. The form also shows fields for mailing address, city, state, ZIP code, telephone, email, and date. A free-text description of the record is another field. You cannot pay online, upload ID, or track a response. No response deadline is posted either. The official Clerk public-records form displays the working request fields.

One practical tip follows from the form itself. Describe the Kosciusko County record with case number, court, document type, and date, even where the form marks nothing required.
Types of Kosciusko County Court Records
The Clerk keeps records for Circuit Court and Superior Courts 1 through 4. Those files span criminal, civil, family, probate, small-claims, infraction, and traffic cases, plus judgment and certified-copy work. The office also maintains the judgment record and judgment docket, processes case papers, and prepares permanent historical records.
- Case Summary and chronological case events
- Pleadings, motions, notices, and public event documents
- Hearing entries, orders, judgments, and dispositions
- Public charge or civil-classification information
- Financial entries, while the Clerk remains the source for an official current balance
- Certified copies authenticated by the Clerk
A transcript is not a docket document. Local rules route transcript production and reporter fees through the court reporter. Ask the assigned court about that channel rather than treating a transcript as an ordinary copied page.
Kosciusko County Docket or Document
Think of the docket, or case-event register, as a chronological index. It shows that a motion, order, hearing, judgment, or clerk action happened. The Event Document is the actual paper attached to an entry. It appears only when public remote access is allowed. A missing link does not mean nothing was filed.
| Record | What it does | Best route |
|---|---|---|
| Case Summary | Identifies the case, court, type, status, and public sections | MyCase |
| Events | Indexes filings, orders, and hearings by date | MyCase or official file |
| Event Document | Shows the paper when public download is allowed | MyCase link or Clerk copy |
| Certified copy | Adds Clerk authentication to the copied document | Clerk counter or mail form |
| Transcript | Records spoken proceedings when prepared | Assigned court reporter |
E-filing is different too. It moves papers into the court system but does not make every filed paper public or downloadable.
What a Court Record Contains
Indiana MyCase offers a clear sense of the fields a case record contains. What the public actually sees depends on case type and access status.
| Header | Case number, court, county and court code, filing date, type, status, and status date. |
|---|---|
| Parties | Public roles and attorneys where access permits. |
| Events | Date, time, description, judge, comments, and related hearing information. |
| Documents | Name, description, effective date, page count, file type, and download permission. |
| Disposition | Judgment, dismissal, sentence, appeal, or other outcome entries. |
| Financials | Charges, credits, payments, transactions, and an as-of balance that can be incomplete. |
The event register may note that an excluded portion exists while hiding its protected content. That marker tells you access is limited. It is not a basis for guessing what the hidden record says.
Kosciusko County Mail Copy Route
The county mail form asks for your name, mailing address, phone, number of copies, certification choice, party names, case number, document type, and the filing or order date. Print the form and mail it in. Payment goes by money order to the Kosciusko County Clerk. Include a self-addressed stamped envelope. Skip personal checks.
The listed cost is $1 per page plus $3 per document for certification. The form promises no turnaround time. Call the Clerk for the current total before mailing, since a dated county schedule does not guarantee that every posted amount still stands.
Mail checklist: Identify one record precisely, select plain or certified copies, include the directed payment form, and add the return envelope.
Prefer to ask in person? County offices list Justice Building hours as Monday through Friday, 8:00 a.m. to 4:30 p.m. Call ahead for a time-sensitive visit and ask for the public records counter.
Certified Copies and Fees
A plain copy reproduces the public record. A certified copy adds the Clerk's authentication. Order it only when the receiving office or process requires it. MyCase downloads make handy reference copies, but they do not arrive certified. The county's court costs and fees page carries the schedule. It is dated July 1, 2023 through June 30, 2024.

That posted date matters. Confirm current charges with the Clerk rather than treating the schedule as timeless.
| Item | Published fact | Action |
|---|---|---|
| Plain copy | $1 per page on the mail form | Confirm total and page count |
| Certification | $3 per document in addition to pages | State which document needs certification |
| Mail payment | Money order; no personal check | Pay the Kosciusko County Clerk |
| Return delivery | Self-addressed stamped envelope | Include it with the request |
Kosciusko County Access Rules
Access to Kosciusko County court files runs on the Indiana Rules on Access to Court Records. Rule 4 opens with a presumption of public access unless Rule 5 or another law excludes the record. The official Rules for Access to Court Records hold the current framework.

These statewide rules control access decisions for Kosciusko County court records. A generic public-records assumption cannot override them.
Indiana's Access to Public Records Act also backs inspection and copying of public agency records. That applies during regular hours. A request must describe the record with reasonable particularity. It generally needs no stated purpose. For court records, though, the court-access rules and case-specific orders still govern.
Public Access and Sealed Records
Rule 5 excludes entire confidential or sealed cases along with specified records. Mental-health cases fall outside public view. The same goes for some investigative requests, privileged or treatment records, protected personal data, certain juvenile material, and anything excluded by statute or court order. Redaction can also hide only protected fields while leaving the rest of a record public. The official Access Rule 4 page states the public-access baseline.

Public access is the starting point for any Kosciusko County court docket search. The presumption only goes so far, though, because the rule carves out exclusions that still apply.
Restricted means restricted. A partial or blank result cannot establish what a sealed, expunged, juvenile, or excluded file contains.
Need more access to your own case? A MyCase party access code may cover it. But if a public document simply is not online, ask the Clerk for a copy rather than filing an extraordinary-access petition.
Kosciusko County Extraordinary Access
For records the rule excludes, Kosciusko County litigants can turn to Rule 9. It opens a formal route to extraordinary access, not a routine copy request. The verified request goes to the court with jurisdiction. Affected people get notice and a chance to respond. A hearing and a written order may follow. The rule demands public-interest and harm findings. It can also place limits on how the material is used. The official Access Rule 9 text lays out that whole process.

Under Kosciusko County's access rule, a court order is one thing. Asking the Clerk's staff to hand over a public paper whose image is missing from the docket record is a separate, simpler request.
